日本のジェンダー不平等と生活保護

２０２４年１０月１７日、国連の女性差別撤廃委員会は第９次日本政府報告を対象とした６回目の審議を、スイス・ジュネーブで開催しました。
On 17 October 2024, the UN Committee on the Elimination of Discrimination against Women held its sixth examination of the 9th Japanese government report in Geneva, Switzerland.

私は昨年ジャーナリストのみわよしこさんと共に傍聴参加させて頂きました。
Last year, I participated in the hearing alongside journalist Yoshiko Miwa.

前回審議は、２０１６年。８年ぶりに出された総括所見では、日本社会における女性差別が依然放置され、世界の流れ、国際基準に照らし大きく遅れを取っている現状があぶり出されたと思います。
The last deliberation was in 2016. I believe the comprehensive findings issued for the first time in eight years highlighted the current situation where discrimination against women in Japanese society remains unaddressed, significantly lagging behind global trends and international standards.

→国連の女性差別撤廃委員会（CEDAW）に参加しました。

冊子の最後に、女性差別撤廃委員会委員プロフィールがありました。
At the end of the booklet, there was a profile of the members of the Committee on the Elimination of Discrimination against Women.

日本人審査員は日本審査には参加していなかったそうですが、唯一の日本人が弊所の特定行政書士三木ひとみ先生のルーツと同じく、ICUご出身ということが誇らしかったです。
It seems that the Japanese judge did not participate in the Japanese judging, but I was proud that the only Japanese member shares the same roots as my boss, Miki Hitomi, as they both come from ICU.

国連勤務の日本人の多くが、ICU（国際基督教大学）ご出身だそうです。
Many Japanese people working for the United Nations are said to be alumni of ICU (International Christian University).

みわよしこさん執筆の記事に、私の名前もありました。
My name was also mentioned in the article written by Yoshiko Miwa.

石破茂総理大臣宛に、男女共同参画担当大臣だった三原じゅん子さんが提出された『日本をジェンダー平等社会にするために　女性差別撤廃委員会の勧告の速やかな履行を求める決議』
A resolution titled ‘Request for the Prompt Implementation of the Recommendations from the Committee on the Elimination of Discrimination against Women to Make Japan a Gender-Equal Society’ was submitted to Prime Minister Shigeru Ishiba by Junko Mihara, who was the Minister for Gender Equality.

『総括所見は、日本のジェンダー平等政策がジェンダー主流化を推進する世界の流れにまったく追い付いていない現状をあぶりだし、日本の女性の権利が大きく制限されている現状に懸念を表明しました。』
The summary findings highlighted that Japan’s gender equality policies are not keeping pace with the global trend of promoting gender mainstreaming, expressing concern over the significant restrictions on women’s rights in Japan.

翻って、こちらは日本国政府による最終見解という『日本の意見』
Conversely, this is the ‘Opinion of Japan’, which is the final conclusion of the Government of Japan.

この後、日本政府はOHCHR(国連人権高等弁務官事務所)に出している拠出金の使途からCEDAW（女性差別撤廃委員会）を除外することを決定し、国連に通告したのです。
After this, the Japanese government decided to exclude CEDAW (the Committee on the Elimination of Discrimination against Women) from the use of the contributions it is making to the OHCHR (Office of the United Nations High Commissioner for Human Rights) and notified the United Nations.

日本弁護士会や新聞社説等では、『国連中心主義を覆す誤った外交方針』『金銭的報復ではなく対話で解決を』といった批判が相次いで発表されました。
Criticism has been repeatedly voiced in the Japan Bar Association and newspaper editorials, including statements such as “an erroneous diplomatic policy that overturns UN centrality” and “resolve issues through dialogue rather than financial retaliation.”

決定の撤回はいまだされておらず、日本が人権後進国であるという国際的評価を裏書きする間違った政府決定と、JNNC世話人亀永能布子さんは記されています。
The decision to retract has not yet been made, and it is noted that Ms. Nofuko Kamenaga of JNNC is a wrong government decision that endorses the international evaluation of Japan as a country lagging in human rights.

Hitomi Law Office, a nationwide administrative scrivener firm that operates year-round and offers a wide range of administrative scrivener services, has not ceased to receive consultations regarding welfare from individuals since its establishment.

福祉事務所で保護受給中の女性から、男性ケースワーカーによる性被害の相談も少なくありません。
It is not uncommon for women receiving protection at welfare offices to consult about sexual victimisation by male caseworkers.

こちらは、昨日届いた、『公開して、記事にして、こういう問題があるのだという真実を発信してほしい』生活保護受給されている女性からの悲痛のメールです。
This is a distressing email from a woman on welfare, received yesterday, in which she asks us to “publish, write articles, and convey the truth about these issues.”

I wish to die.

彼のやった事は罪ではないんでしょうか？
Isn’t what he did a crime?

昨夜、幻聴と首を絞められている感覚に苦しくて、自傷行為をして入院しました。法テラスに電話したところ、告訴となる刑事事件は扱えなくて民事だけだそうです。
Last night, I was in distress due to hallucinations and a feeling of being strangled, so I was hospitalised. When I called the Legal Terrace, they said they can only handle civil cases, not criminal cases that could lead to prosecution.

男性ケースワーカーが（ドアを閉められないように）玄関に足を入れたことやちゃんとした事情があるから、急に来ないでほしいと伝えたのに、無視された結果、私は過去の性被害の記憶すべてがフラッシュバックして、病気も悪化した。人の人生が狂うほど、最悪な行為をしたことを、きちんと理解していますか？
The male caseworker put his foot in the entrance (so that the door couldn’t be closed) and I explained that there were proper reasons for not wanting him to come suddenly, yet I was ignored and as a result, all my memories of past sexual abuse came flooding back and my illness worsened. Do you truly understand that such worst acts can completely disrupt a person’s life?

男性ケースワーカーが一人で女性宅を訪問し、長時間滞在するケースの相談も少なくなくこうした現状に異常性を感じています。
I feel that it is abnormal for a male caseworker to visit a woman’s home alone and stay for long periods of time, as there are not a few cases like this.

同性のケースワーカーにしてほしいとご本人が福祉事務所に頼んでも長らく放置されていたところ、行政書士から連絡をした途端、女性職員に担当が代わったケースもありました。
There have been cases where, despite the individual requesting that a same-sex caseworker be assigned to them at the welfare office and this being left unattended for a long time, the moment a contact was made by our gyoseishoshi lawyer, the case was handed over to a female staff member.

また、女性が担い手となることが大半の介護と生活保護の問題でも、最近とても信じがたい事件がありました。
Additionally, there was a recent and quite incredible incident regarding the issues of care and welfare, which are often shouldered by women.

被害者の方から担当女性行政書士がヒアリングし、現在毎週弁護士JP/ヤフーニュースで週一回連載している生活保護のシリーズ記事で随時公開されますので、ぜひご覧いただければと思います。
The female gyoseishoshi lawyer in charge is now conducting hearings with the victim. Currently, a series of articles on welfare is being published weekly on Lawyer JP/Yahoo News, and updates will be released as they come. I hope you can take a look.

日本社会において、女性差別や偏見が黙認されていることで、どのような弊害が実際に起きているのか、目の当たりにしています。
In Japanese society, I have witnessed the actual harms caused by the tacit acceptance of discrimination and prejudice against women.
